Decisions and orders on claims for exemption

Pursuant to paragraph 18(1)(a) of the Hazardous Materials Information Review Act, the Chief Screening Officer of the Hazardous Materials Information Review Commission hereby gives notice of the decisions of the screening officer respecting each claim for exemption and the relevant material safety data sheet (MSDS) listed below.

The subject of the claim on which the screening officer issued the decision is the chemical identity of two ingredients.

8. The Notice of Filing published in the Canada Gazette, Part I, on May 21, 2005, listed the subject of the claim bearing Registry Number 6124 to be the chemical identity of one ingredient. The subject of the claim on which the screening officer issued the decision is the chemical identity of three ingredients.

9. The Notice of Filing published in the Canada Gazette, Part I, on May 21, 2005, listed the subject of the claim bearing Registry Number 6172 to be the chemical identity of one ingredient. The subject of the claim on which the screening officer issued the decision is the chemical identity of two ingredients.

10. The Notice of Filing published in the Canada Gazette, Part I, on May 21, 2005, listed the subject of the claim bearing Registry Number 6173 to be the chemical identity of four ingredients. The subject of the claim on which the screening officer issued the decision is the chemical identity of five ingredients. Subsequent to the issuance of the decision on the claim for exemption, the claimant advised the Commission that it did not wish to avail itself of the exemption.

11. The Notice of Filing published in the Canada Gazette, Part I, on May 21, 2005, listed the subject of the claim bearing Registry Number 6177 to be the chemical identity and concentration of two ingredients. The subject of the claim on which the screening officer issued the decision is the chemical identity and concentration of four ingredients.

12. The Notice of Filing published in the Canada Gazette, Part I, on November 12, 2005, listed the subject of the claim bearing Registry Number 6210 to be the chemical identity of one ingredient. The subject of the claim on which the screening officer issued the decision is the chemical identity and concentration of two ingredients and the chemical identity of one ingredient.

13. The Notice of Filing published in the Canada Gazette, Part I, on February 4, 2006, listed the subject of the claim bearing Registry Number 6280 to be the chemical identity and concentration of four ingredients. The subject of the claim on which the screening officer issued the decision is the chemical identity and concentration of five ingredients.

14. The Notice of Filing published in the Canada Gazette, Part I, on July 15, 2006, listed the subjects of the claims bearing Registry Numbers 6620 and 6656 to be the chemical identity of four ingredients as well as the concentration of one ingredient and the chemical identity and concentration of three ingredients as well as the concentration of one ingredient, respectively. The subject of the claims on which the screening officer issued the decisions is the chemical identity and concentration of five ingredients.

There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid with the exception of the claims bearing Registry Numbers 6054, 6280, 6620 and 6656, which were found to be partially valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the claims bearing Registry Numbers 5801, 6131, 6132, 6182, 6213, 6255 and 6256 were filed complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 6106, 6136, 6137, 6142, 6265 and 6266, being claims from an employer in the province of Alberta, the screening officer found that the MSDSs relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code 2006 of the Province of Alberta.

Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDS in respect of which the remaining claims were filed did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 5477

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with water for at least 30 minutes;

2. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be washed with water for at least 30 minutes;

3. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Number 5643

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose the presence of 2-butanone in the controlled product, its CAS Registry Number 78-93-3 and its percent concentration;

2. Disclose the Exposure Limit Values ACGIH TLV–TWA = 200 ppm and ACGIH TLV–STEL = 300 ppm for 2-butanone;

3. Disclose the presence of titanium dioxide in the controlled product, its CAS Registry Number 13463-67-7 and its percent concentration;

4. Disclose the Exposure Limit Value ACGIH TLV–TWA = 10 mg/m³ for titanium dioxide;

5. Amend the MSDS to describe the subheading Odour Threshold as "not applicable";

6. Add oxides of nitrogen to the list of hazardous decomposition products;

7. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Number 5797

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Replace the percent concentration ranges for alkoxylated alkyl phenol and alkyl sulfonate with acceptable WHMIS percent concentration ranges;

2. Add inhalation and ingestion as routes of entry;

3. In relation to the first aid information shown on the MSDS for ingestion, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped;

4. Disclose the Exposure Limit Values ACGIH TLV–TWA = 200 ppm and ACGIH TLV–STEL = 400 ppm for isopropanol;

5. Disclose that an ingredient in the controlled product is incompatible with aluminum and that an explosion may result if aluminum is mixed with the controlled product;

6. Disclose an LC₅₀ (4 hours, rat) value of 17 000 ppm for isopropanol;

7. Disclose an LD₅₀ value for one of the confidential hazardous ingredients in an acceptable manner;

8. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause testicular and kidney effects in laboratory animals;

9. Disclose that inhalation of an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals and that ingestion of that same ingredient has been shown to cause fetotoxic effects in laboratory animals at maternally toxic dose levels;

10. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

Registry Number 5881

In the opinion of the screening officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose the percent concentration of butoxyethanol-2 in an acceptable manner;

2. Add eye contact as a route of entry;

3. Disclose that an ingredient in the controlled product has been shown to cause eye irritation in laboratory animals;

4. Disclose that exposure to the vapours of an ingredient in the controlled product has been shown to cause moderate to severe eye irritation in laboratory animals;

5. Add oxides of nitrogen to the list of hazardous decomposition or combustion products;

6. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2B.

Having regard to the foregoing, and pursuant to sections 16 and 17 of the Hazardous Materials Information Review Act, notice is hereby given that the screening officer has, for the claims bearing Registry Numbers 6054, 6280, 6620 and 6656, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, including disclosing the identities of one, two, two and two ingredients respectively which were included among the information in respect of which the claims for exemption were made and to provide a copy of the amended MSDS to the screening officer within 40 days of expiry of the appeal period.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the screening officer has, for each of the remaining above-noted claims, with the exceptions of those claims bearing Registry Numbers 5801, 6106, 6131, 6132, 6136, 6137, 6142, 6182, 6213, 6255, 6256, 6265 and 6266, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer within 40 days of expiry of the appeal period.

In the case of the claims bearing Registry Numbers 6106, 6136, 6137, 6142, 6265 and 6266, the screening officer has ordered the claimant to comply with the provisions of the Occupational Health and Safety Code 2006 of the Province of Alberta, except that the information in respect of which the claims for exemption were made does not have to be disclosed, and to provide a copy of the amended MSDS to the screening officer, within the respective time period specified in the foregoing paragraph.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the screening officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer.
